Fuchs Asset Management’s remuneration policy is compliant with the directive and is available for consultation at the registered office of Fuchs Asset Management S.A. : 49, Boulevard Prince Henri L- 1724 Luxembourg.

In accordance with Regulation 2016/679 of the European Parliament and Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation hereafter called “GDPR” or “the Regulation”) that will apply as from 25 May 2018, your personal data may be processed by Fuchs Asset Management (hereinafter “FUCHS AM”), in the course of FUCHS AM business relationship with you.

Under GDPR, personal data may only be collected, recorded, used and transferred in compliance with the Regulation, in good faith and transparently for the date subject, for specified, explicit and legitimate purpose without going further processed in a manner that is incompatible with these purposes.

Processing means any operation or set of operations which is performed on personal data or on sets of personal data, whether or not by automated means, such as collection, recording, organisation, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclose by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or disclosure.

Within FUCHS AM, the role of “data controller” is exercised by M Timothé FUCHS who will determine the purposes and means of the processing of personal data of all FUCHS AM employees and Clients, mainly the initiators and the members of the Boards of the Funds for which FUCHS AM has been designated Management Company, but also Prospects and Service Providers.

We kindly inform the readers that in the view of FUCHS AM’s scope and volume of activities, its has been decided not to designate a data protection officer (hereinafter “DPO”) at the level of the Company, considering the processing completed by FUCHS AM is not carried out by a public authority or body, the core activities of the data controller and processor (if any) does not require a regular and systematic monitoring of data subjects on a large scale; nor large scale of data pursuant to article 9 and personal data relating to criminal convictions ad offences referred to in Article 10.

FUCHS AM has put in place an administrative organization and corporate governance structure which encompasses appropriate security measures to protect your data. Internal controls are foreseen as to ensure adequacy with the Regulation.

FUCHS AM holds appropriate procedures, policies and processes amongst which a data protection policy proportionated to its activities as well as a Code of conduct which contains notably guidelines to be followed on the right behaviours to be adopted as to ensure an accurate protection of the information. A procedure defining the means to protect the information completes the framework.

In some circumstances, it might be that  data be collected, processed and therefore available by other Company of the Group Fuchs and/or closed partners involved in your business model for the benefit of the relationship and legitimated for the purpose of either the performance of a contract to which the data subject is party or in order to take steps at the request of the data subject prior entering into a contract, for compliance with a legal obligation to which the controller is subject or, for the purpose of the legitimate interests pursued by the controller or by a third party (e.g. Transfer agent collecting your personal data within the scope of its commitment of identifying and verifying your identity under the anti-money laundering and counter financing terrorism purposes).

Your personal data will not be transmitted, except in the above circumstances, nor sold, exchanged or rented to anyone, unless a prior information has been provided to you and if we  obtained your prior agreement up front or, within the context of a judicial proceeding.

The Client (usually the “Fund”) and FUCHS AM, in representation of the Fund from which it has received mandate, being designated as “Management Company” by the Fund, may, in the scope of their relationship and, in some circumstance, play jointly the role of “data controller” and, determine the purposes and means of the processing of personal data.

Additional details on the lawfulness of processing adjusted to your situation might be available on the precontractual and contractual documentation provided to you. Equally, the personal data retention period will be adjusted accordingly and your data will not be held for longer than necessary with regard to the purpose of the data processing.

Fuchs AM will make sure the contractual and/or precontractual agreement to which it is party with the other actors of the Fund will encompass the role, commitments and duties of each with clear, transparent and precise terms, including provisions as to cope with the Regulation especially the one relating to security, confidentiality and protection of your personal data. Only third parties that demonstrate sufficient guarantees to secure the protection of the personal data processed and appropriate technical and organisational measures would be eligible to selection. An up-front due diligence will be realised aside the quarterly due diligences.

Within FUCHS AM your satisfaction is our; we acknowledge to make our best efforts to ensure your personal data are available to you, for you to exercise your rights and are retained in compliance with the minimum confidentiality requirement that shall apply to such nature of data.

Regulation 2016/679 provides you several rights notably the right to request from the controller information, access to, rectification or erasure of your personal data, restriction of processing as well as the right to object to processing, to contest a decision based solely on automated processing and the right to data portability.

To exercise your rights, we invite you to get closer to FUCHS AM – M. Timothé Fuchs who will provide information on action taken on a request to the data subject without undue delay and in any event, within one month of the receipt of the request. We kindly inform you that the period may be extended by two further months where necessary, taking into account the complexity and number of the request.

In such a last case, we will inform you of any extension within one month of the receipt of the request, together with the reasons for the delay.
